In the name of God the Father, the Son and the Holy Ghost Amen.

I Bernard Henry Waller, of the Town of Germantown, in the County of Clinton and State of Illinois, being of sound mind and Memory, do make and publish this my last Will and Testament.

First: I order and direct that all my just debts and funeral expenses shall be paid with convenient speed.

Second I give devise and bequeath to my stepson Frank Eilers all my real Estate viz: The East half of North East South West quarter of Section (33) thirty three Town one (1) Range four (4) – Also the North half of South West quarter of Section (8) eight in Township number one (1) North of Range Number Four (4) west of the Third principal Meridian containing eighty acres (80), also the South Half of North half of North West quarter of South East quarter of section Number Twenty (20) containing ten (10) acres – also the South East quarter of North West quarter of South East quarter of section Twenty (20) containing Ten (10) acres, all in Township one (1) North of Range (4) Four west of Third principal Meridian, to have and to hold the same to himself his Heirs and assigns forever, provided that the said Frank Eilers, my stepson, faithfully fulfill the following obligations.

1) It shall be the duty of my stepson Frank Eilers to give to my wife Anna Maria nee Goers during her natural life annually the third part of all the crops produced every year on said Real Estate.

2) It shall be the duty of my said stepson Frank Eilers to pay to my stepson Gerhard Kurhoff the sum of three hundred dollars $300.00 and to pay likewise to my stepson Gerhard During the sum of Three hundred dollars.

3) It shall be the duty of my said stepson Frank Eilers to pay to the Rev. Rector of St. Boniface’s Roman Catholic Church of Germantown Clinton County Illinois the sum of two hundred dollars $200.00 one half of which sum shall be used for the celebration of holy masses for the repose of my soul, the other half for the Benefit of St. Boniface’s Roman Catholic congregation of Germantown Clinton County Illinois.

Third I give and bequeath to my stepson Herman Koellen the sum of one hundred dollars $100.00.

I hereby revoke all wills by me heretofore made and I constitute Henry Hagen of Germantown Illinois to be the sole executor of this my last Will and Testament without being obliged to give a bond.

In Witness whereof I the above named Testator have hereunto set my hand and seal this 10th day of August in the year of our Lord One Thousand eight hundred and ninety two.

Personally appeared in open court Gerhard Gisenhues and Frank Boeving subscribing Witnesses to the annexed Instrument of writing purporting to be the last Will and Testament of Bernard H. Waller late of said County deceased, who being duly sworn according to law do depose and say each for himself, that they were present and saw said Bernard H. Waller sign said Will in their presence and that they believe that the said Testator was of sound Mind and Memory, of lawful age, and under no constraint when he signed said Will.
