Last Will and Testament of Bernard SOMMERS
In the name of God. Amen: I Bernard Sommers being in sound health of body and of disposing mind and memory do make and publish this my last Will and Testament hereby revoking all forever wills by me at any time made.
First I direct that all my first debts including funeral Expenses and the expenses of administration be paid by my Executor.
Second I give devise and bequeath unto my beloved wife Maria A. SOMMERS all my remaining estate both real and personal in whatever it may consist or wherever situated at the time of my decease to be by her used and controled during her natural life precisely the same a I myself might do were I living.
Third After the death of my beloved wife Maria A. Sommers I give devise and bequeath the following legacies to wit:
Fourth I give devise and bequeath to the Trustees of the Roman Catholic Church at Breese Clinton County Illinois the sum of Three Thousand Dollars. $3000.00
Fifth I give devise and bequeath to Bernard HAGEN my nephew the sum of Eight Thousand Dollars $8000.00
Sixth I give devise and bequeath to Elizabeth MEYBERG my niece the sum of Two Thousand Dollars. $2000.00
Seventh I give devise and bequeath to Elizabeth HAULKLAN the sum of Five Hundred Dollars. $500.00
Eighth I give devise and bequeath to Maria Angela HULSCAMP the sum of Five Hundred Dollars $500.00.
Ninth I give devise and bequeath to Heinrich IMMETHUN the sum of Five Hundred Dollars $500.00
Tenth I give devise and bequeath to Elizabeth KLINKER the sum of Five Hundred Dollars $500.00
Eleventh I give devise and bequeath to Gerhard IMMETHUN absolutely and forever the following described Real Estate to wit: The South East quarter of section Number Eleven "11". and the North West quarter of the South West quarter of section No Twelve "12" also that part of the North East quarter of section No. thirteen "13" lying on the west side of Shoal Creek and bounded as follows to wit: on the West and South by the lines of said quarter section No. Thirteen "13" on the North and East by Shoal Creek and also all that part of the South Half of the North East quarter of section number Eleven "11" on what is known as the Island and south of Shoal Creek all lying and being in Township Number Two (2) North of Range No. Four "4." West of 3rd principal meredian in Clinton County Illinois together with the flowing mill situate thereon and all the personal property on the said farm and premises above described at the death of my said wife Maria A. Sommers subject however to the following legacies to my three Sisters to be paid by the said Gerhard Immethun that is to say.
Twelfth I give devise and bequeath to Elizabeth NIPPER my sister the sum of One Thousand Dollars $1000.00
Thirteenth I give devise and bequeath to Maria MEYBERG my sister the sum of Two Thousand Dollars $2000.00
Fourteenth I give devise and bequeath to Eugel HAGEN my sister the sum of Seven Thousand Dollars $7000.00 but if my beloved wife Mary A. Sommers survives me and the said Gerhard Immethun pays the Ten Thousand Dollars $10000.00 herein before bequeathed to my three sisters, to my said wife Maria A. Sommers as provided in Articles of copartnership between Bernard Sommers and Gerhard Immethun bearing date July the first A.D. 1867 then and in that event the said Gerhard Immethun shall not be compelled to pay the said legacies to my three sisters hereinbefore bequeathed to them but said legacies in that event shall be paid to them out of my Estate not otherwise bequeathed after the death of my beloved wife Maria A. Sommers.
Fifteenth I give devise and bequeath to the poor of the Parish of Hennuette Aut. Loningen in the Grand Duchy of Oldenburg Germany, the sum of Two Hundred Dollars $200.00.
Sixteenth I give devise and bequeath to the Poor of the Parish of Kueheim Aut Clappenburg in the Grand Duchy of Oldenburg Germany the sum of Two Hundred Dollars $200.00 and I hereby appoint Gerhard IMMENTHUN as Trustee for the proper application and distribution of the sums of money bequeathed by me in the two last bequests numbered fifteen and Sixteen.
Seventeenth I give devise and bequeath to Gerhard Immenthun the sum of Five Hundred Dollars $500.00 to be applied by him in the reading of Masses for the peace of the departed souls of myself and that of my beloved wife Maria A. Sommers.
Eighteenth and lastly I devise and bequeath all the residue and remainder of my estate both real and personal after the death of my beloved wife Maria A. Sommers to Bernard Hagen, Elizabeth Meyberg, Elizabeth Haulklan, Maria Angela HULSKAMP, Heinrich Immethun, Elizabeth Klinker, Gerhard Immenthun, Elizabeth Nipper, Maria Meyberg and Eugel Hagen. The same to be sold and the proceeds to be equally devided between the above named parties.
I appoint Gerhard Immethun my friend to be the Executor of this my last Will and Testament.
In Witness Whereof I have hereunder set my Hand and Seal this the twenty third day of November in the year of our Lord one thousand Eight Hundred and Sixty seven.
